Assumption of Risk Contract

This Agreement is made between Ryann Pinkerton, herein referred to as "Provider," and the client, herein referred to as "Client".

1. SERVICES: Provider agrees to provide Myofascial Release and Pilates services, including the use of Pilates equipment, to Client.

2. ASSUMPTION OF RISK: Client acknowledges that participating in Myofascial Release and Pilates involving the use of Pilates equipment carries inherent risks, including but not limited to, the risk of injury from falls, equipment malfunction, or improper use of the equipment. Client acknowledges that participating in Myofascial Release and Pilates involves physical activity and bodywork techniques, which may result in certain risks, including but not limited to, muscle soreness, fatigue, temporary discomfort, or injury. Client understands and voluntarily assumes all such risks associated with the services provided by Provider.

3. CLIENT'S RESPONSIBILITIES: Client agrees to follow all safety guidelines and instructions provided by Provider regarding the use of Pilates equipment. Client further agrees to disclose any physical limitations or health concerns that may impact their ability to safely use the equipment. Client agrees to disclose any medical conditions, injuries, or physical limitations to Provider prior to participating in any session. Client understands that it is their responsibility to communicate openly with Provider regarding their comfort level during the sessions and to inform Provider of any changes in their health status that may affect their ability to safely participate.

4. RELEASE OF LIABILITY: Client releases Provider, their employees, agents, and affiliates from any and all liability, claims, demands, actions, or causes of action arising during the Myofascial Release and Pilates sessions, including but not limited to, any injuries or damages sustained during or as a result of participation in the sessions, or related to the use of Pilates equipment.

5. CONSENT TO TREATMENT: By agreeing to this contract, Client acknowledges that they have been fully informed of the nature and risks associated with Myofascial Release and Pilates and voluntarily consent to receive such treatment from Provider.

6. CONFIDENTIALITY: Provider agrees to maintain the confidentiality of all client information disclosed during the course of the sessions, in accordance with applicable laws and professional standards.

7. ACKNOWLEDGMENTS: Client expressly agrees that the foregoing assumption of risk agreement is intended to be as broad and inclusive as permitted by the law in Canada and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Client acknowledges that Provider offers a service to her clients encompassing the entire bodywork spectrum. Client acknowledges that they have carefully read this contract and fully understand that it is a release of liability, and express assumption of risk agreement.
